Terms and Conditions
1. Introduction and Acceptance of Terms
These Terms and Conditions ("Terms") constitute a legally binding agreement between the platform user ("User" or "You") and MedConsult International ("MCI" or "Company"). MCI is a platform specialized in facilitating access to second medical opinions and remote consultation services.
By accessing or using the platform or any of its services, you acknowledge that you have read, understood, and agreed to be fully and unconditionally bound by these Terms. If you do not agree to any part of these Terms, you must immediately discontinue using the platform. The platform disclaims all responsibility for any misunderstanding.
MCI reserves the right, at its sole discretion, to review or modify these Terms at any time as required by platform interests, emergencies, or force majeure. Any modifications become effective immediately upon publication. Continued use of the platform constitutes implicit acceptance of the updated Terms. Users are responsible for periodically reviewing these Terms.
2. Scope of Services
MCI operates as a specialized platform facilitating communication between patients and a global network of leading medical institutions and expert physicians to obtain second medical opinions and advanced consultation services.
Services include, but are not limited to:
- Advanced Medical Consultation Coordination: Facilitating remote consultations (written or video) with carefully selected global experts and institutions.
- Complex Case Management: Supporting multidisciplinary cases including tumor boards, cardiac, neurological, genetic, and rare diseases to ensure comprehensive treatment planning.
- Medical Tourism Programs: Coordinating treatment abroad, including appointments, medical report transfers, and guidance for a seamless experience.
- Logistical Support Coordination: Assisting via third-party providers with travel, flights, accommodation, and transportation. MCI acts only as a coordinator and bears no responsibility for third-party service quality or obligations.
3. Partnerships and Referral Programs
MCI collaborates with doctors, hospitals, and healthcare institutions ("Partners") under the following terms:
- Referring Partner Program: Partners must obtain explicit written patient consent before sharing any medical data. MCI disclaims liability for referrals made without proper consent.
- Collaborative Participation: Partners may optionally join video consultations to enhance care continuity.
- Commissions: Partners are entitled to commissions for completed referrals as defined in separate agreements.
- Partner Responsibilities: Partners must provide accurate, complete, and updated medical information. MCI is not liable for inaccuracies.
- Independence of Parties: Partnership does not imply endorsement or representation. MCI is not responsible for partners' medical, administrative, or financial practices.
4. Financial Terms and Payments
- Service Fees: Charged for administrative and operational processes. Clearly communicated before payment.
- Consultation Fees: Set by the medical provider and vary based on case complexity and specialization.
- Payment Methods: Secure online gateways (credit cards, bank transfers).
- Cancellation & Refund Policy: Service fees are non-refundable once processing begins. Consultation refunds depend on provider policies. Full refund applies only if MCI fails to deliver due to internal issues.
- Currency: Exchange rates and bank charges are outside MCI's control.
5. User Eligibility and Account Obligations
- Users must be legally adults (or supervised minors with guardian consent).
- All information provided must be accurate and updated.
- Users are responsible for account security.
- Platform use is strictly personal and non-commercial.
- Misuse or privacy violations may result in legal consequences.
6. Medical Data Privacy and Security
- Data Collection: Includes personal and medical records strictly for consultation purposes.
- Data Security: Protected via encryption (SSL) and secure servers in compliance with international standards (e.g., GDPR, Saudi PDPL).
- Data Sharing: Only with selected medical partners. No selling or marketing use.
- User Rights: Access, update, or request deletion of personal data subject to legal retention requirements.
7. Medical Disclaimer and Limitations
- MCI is NOT a healthcare provider. It does not diagnose or treat.
- Second Opinions: Advisory only; must be discussed with treating physicians.
- No Doctor-Patient Relationship with MCI.
- Remote Limitations: Consultations rely on submitted data and may not replace physical exams.
- Not for Emergencies: Users must seek immediate local medical care.
- User Responsibility: All health decisions are solely the user's responsibility. MCI bears no legal liability.
8. Intellectual Property
- All platform content is owned by MCI and protected by law.
- Trademarks cannot be used without permission.
- Users receive a limited, non-transferable license for personal use only.
- Violations may result in legal action under Saudi law.
9. Prohibited Uses
Users must not:
- Engage in illegal activities.
- Provide false or misleading information.
- Hack, disrupt, or damage the platform.
- Access unauthorized data.
- Use bots or scraping tools without written permission.
- Harass, abuse, discriminate, or misuse the platform or MCI's name on other platforms to threaten, insult, defame, or discriminate against any person or group.
MCI may suspend or terminate violating accounts.
10. Limitation of Liability
MCI is not liable for indirect or consequential damages, loss of profits, data, or reputation, third-party actions or content. Total liability is limited to fees paid in the last six (6) months.
11. Indemnification
Users agree to indemnify and protect MCI from any claims, damages, or legal costs arising from violations of these Terms, platform misuse, submitted content, or breaches of third-party rights or applicable law.
12. Governing Law and Dispute Resolution
Governed by Saudi Arabian law. Disputes shall be resolved exclusively in the competent courts of Riyadh, Kingdom of Saudi Arabia. Users waive objections to jurisdiction and venue.
13. General Provisions
- Entire Agreement: These Terms, together with other policies published on the platform, constitute the entire agreement and supersede prior communications.
- Severability: Invalid provisions do not affect the remainder.
- No Waiver: Unless in writing and signed by an authorized MCI representative.
- Assignment: Users may not assign obligations without MCI's prior written consent. MCI may assign its rights and obligations.
